...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an order, direction, or a writ one in the nature of mandamus, declaring the action of the respondents nos 1 to 3 in not removing the illegal wall constructed on a public road i.e, on cross no. 5 of the SBI colony Madanapalle town of Annamayya district by the Respondent no.
4 and 5 along with their men though representations vide EP.1 and P2 were submitted to the respondents 2 and 3 and to other officials by the petitioner school and the respondents 2 and 3 in not taking any legal action against the road grabbers/respondents nos 4 and 5 as illegal arbitrary, unconstitutional and also in violation of the Municipal laws of the state of AP and consequently direct the respondents 2 and 3 to remove the illegally constructed wall on the public road by the respondents nos.4 and 5 which road is called as Cross No. 5 of the SBI colony Madanapalle town forthwith as it is in violation of several municipal laws and also in violation of the due process of law and also principles of natural justice, and to pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents 2 and 3 to remove the illegally constructed wall on the public road by the respondents nos.4 and 5 which road is calied as Cross No. 5 of the SBI colony Madanapalle town forthwith and to pass Counsel for the Petitioner(S):

Sri Laxmi Narayana Gudapati, learned Standing Counsel appearing for the Municipality, on written instructions submits that the grievance of the petitioners has been adequately addressed by respondent Nos. 4 and 5 and that the unauthorized wall, which was constructed and was obstructing ingress and egress to the petitioners’ school, has been removed by the respondent authorities. It is further submitted by the learned Standing Counsel in the written instructions that the respondents have taken appropriate action and removed the obstructing wall. 2. Recording the same, no further orders are required to be passed in this writ petition. 3. Accordingly, this writ petition is disposed of. There shall be no order as to costs.
