Kausik (Rejected) CRM (NDPS) 1468 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with English Bazar Police Station Case No. 149 of 2026 dated 02.02.2026 under Sections 111/61(2) of the BNS, 2023 along with sections 21(c)/25/27A/29 of the NDPS Act, 1985. And In the matter of : Mahibuba Khatun & Anr. ……Petitioners. Mr. Kusal Kumar Mukherjee Mr. Arijit Bose ……for the Petitioners. Mr. Sagar Saha Ms. Nayana Mukhopadhyay ……for the State. Learned advocate appearing for the petitioner submits petitioners are ladies who have been falsely implicated in connection with the instant case. According to the State there has been alleged recovery of more than 15 Kgs. of Brown Sugar from a godown. The investigation of the case is still in progress. In the seizure list, prima facie it appears there is signature of one Mahibuba Khatun as also Mahomuda Bibi. Having considered the same and the fact that investigation of the case is still progressing, I am not inclined to release the petitioner on bail. Accordingly, CRM (NDPS) 1468 of 2026 is dismissed. 2 Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
