Learned advocate appearing for the petitioners submits that the subject-matter of the present case relates to alleged recovery of 400 bottles of Phensedyl and petitioners are in custody for eight months. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail. I have taken into account that in the charge-sheet, prosecution has relied upon 28 witnesses. Having considered the time frame which will be required to take the trial to its logical conclusion, I am inclined to release the petitioners on bail. As such, the prayer for bail of the petitioners is allowed. Accordingly, the petitioners viz., 1. Dinesh Kumar and 2. Azrail Sk @ Ajrail Sk. shall be released on bail upon furnishing bond of Rs.20,000/- each, with two sureties of Rs.10,000/- each, one of whom must be local, to the 2 satisfaction of the learned Judge, Special Court under the NDPS Act, Nadia at Krishnagar. If on bail, the petitioners shall be physically present on each and every date before the learned Special Court and shall not leave the jurisdiction of the district of Nadia without prior permission of the learned Special Court. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 1371 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
