The two petitioners, who are the plaintiffs before the trial court, preferred a suit on 27.12.2018 before the court of Additional District Judge, Srinagar. 2. In said civil suit, the petitioners have named two respondents herein as two defendants. 3. In said civil suit, two respondents came forward with their written statement filed on 08.03.2023 which came to be entertained and the suit getting posted for framing of issues and arguments. 4. From said date of 8th March, 2023, the petitioners, as plaintiffs, have been appearing on successive dates of hearing P a g e | 2 CM(M) 78/2026 CM(1215/2026)] in civil suit without getting bothered by the fact that the written statement from the end of the two respondents have come to be entertained beyond the prescribed period of filing of the written statement. It has occurred to two petitioners only in March, 2026 to bear an agitation that the written statement from the end of the respondents ought not to have taken place in March 2023. 5. The petitioner has approached with the present petition under Article 227 of the Constitution of India after three years of putting up with fact of order dated 08.03.2023. 6. After arguing for a while, learned counsel for the petitioners seeks to withdraw the present writ petition. Dismissed as withdrawn. 7.
