Kausik (Allowed) CRM (NDPS) 1452 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kharagpur (Local) Police Station Case No. 1116/2025 dated 21.12.2025 under Section 20(b)(ii)(c)/25/29 of NDPS Act, 1985. Learned advocate appearing for the petitioner submits that the subject matter of recovery in the present case is 22.957 Kgs. of Ganja and the petitioner is in custody for 7 months. Charge sheet has been submitted. Charges framed and some time will be required to take the trial to its logical conclusion as the prosecution has relied upon 13 witnesses. As such, petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail but is unable to refute the factual circumstances presented by the petitioner. 2 Having considered that there are 13 witnesses on whom the prosecution relies upon and some time will be required to take the trial to its logical conclusion, I am inclined to release the petitioner on bail. Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Mustaqui @ Mustafa shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, under NDPS Act, 4th Court, Paschim Medinipur. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Paschim Medinipur without the prior permission of the learned Special Court. Thus, CRM (NDPS) 1452 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
