Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 8 months and till date there has been no progress in the case. There is no possibility of the trial being taken to its logical conclusion, as such, the petitioner may be released on bail. Learned senior advocate appearing for the NCB submits that the seizure in the present case is 8765 bottles of phensedyl from a truck. Petitioner happens to be the owner of the truck who was present. There are seven witnesses on whom the prosecution has relied upon and only because of absconsion of one of the accused 2 the case could not proceed. Already charges have been framed and the next date has been fixed on 8th August, 2026 for witness action to commence. Having regard to the huge quantity of seizure in the present case, I am not inclined to release the petitioner on bail. Learned trial court would expedite the process of trial. Accordingly, CRM(NDPS)1381 of 2026 is dismissed at this stage. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
