1. The instant pre-arrest bail application has been filed under Section 482 BNSS on behalf of the petitioner, who is having apprehension of his arrest in connection with FIR No.380/2023 registered at Police Station Civil Line, District Ajmer for the offences under Sections 3 and 10 of Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) act, 2022 and Sections 419, 420 and 120B of IPC.
2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Co-accused Dinesh Kumar has been enlarged on bail by a Coordinate Bench of this Court vide
order dated 08.01.2024. The present FIR has been lodged against the petitioner on false and concocted grounds. No involvement of the petitioner is made out from the material available on record.
[2026:RJ-JP:18017] (2 of 2) [CRLMB-5305/2026] The petitioner is ready and willing to cooperate with the investigation. Therefore, the anticipatory bail application of the petitioner may be allowed.
4. Learned Public Prosecutor has vehemently opposed the bail application and submitted that the petitioner appeared in the examination as a dummy candidate in place of the original candidate, Dinesh Kumar, for the School Lecturer Examination,
2022. It is further submitted that the FSL report indicates that the petitioner had impersonated the said candidate. It is also contended that the petitioner has been absconding during the course of investigation, as per the Investigating Officer. Co- accused Dinesh Kumar has been enlarged on bail after his arrest on regular bail. It is further submitted that custodial interrogation of the petitioner is required.
5. I have considered the contentions advanced at Bar and perused the material available on the record.

Considering the overall facts and circumstances of the case and the arguments advanced by learned Public Prosecutor, particularly the requirement of custodial interrogation in a case involving impersonation by a dummy candidate in a competitive examination, this Court does not find it to be a fit case for extending the indulgence of anticipatory bail to the accused- petitioner.
7. Accordingly, the instant pre-arrest bail application is dismissed.
