Learned advocate appearing for the petitioner submits that the subject-matter of the present case relates to alleged recovery of 1686 grams of Brown Sugar and petitioner is in custody for nine months. It has been submitted that charge- sheet has already been submitted and there is no possibility of the trial concluding in near future. As such, petitioner prays for bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail as recovery in the present case was from the joint possession of the petitioner and another. Having considered the aforesaid, I am of the opinion that the petitioner has failed to overcome the rigours of Section 37 of the NDPS Act. As such, the prayer for bail of the petitioner is rejected at this stage. 2 Petitioner will renew his prayer for bail after the evidence of seizure list witnesses is over. The application for bail, being CRM (NDPS) 1360 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
