Kausik (Allowed) CRM (NDPS) 1467 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Gazole Police Station Case No. 71 of 2026 dated 25.01.2026 under Sections 21(c)/29 of the NDPS Act, 1985. And In the matter of : Pikesh Sarkar & Anr. ……Petitioners. Mr. Md. Wasim Akram Ms. Sabrina Parveen ……for the Petitioners. Mr. Arushi Rathore ……for the State. Learned advocate appearing for the petitioner submits that petitioner is similarly placed as other accused namely, Uttam Sarkar who has been granted bail in CRM (NDPS) 1227 of 2026. Learned advocate for the State opposes the prayer for bail but is unable to refute the issue relating to parity of the present petitioner with the other accused who has been granted bail. In view of the overall circumstances, petitioner be released on bail on same terms and conditions by the learned Special Court as was granted to Uttam Sarkar in CRM (NDPS) 1227 of 2026. 2 Accordingly, CRM (NDPS) 1467 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
