Kausik (Rejected) CRM (NDPS) 1455 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kaliachak Police Station Case No. 848/2025 dated 21.05.2025 under Section 22(C)/25/27A/29 of the NDPS Act. And In the matter of : Bijay Kumar @ Vijay ……Petitioner. Mr. Arup Kumar Bhowmick ……for the Petitioner. Mr. L. Vishal Kumar ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for 1 year and 2 months and till date charges have not been framed. Learned advocate for the State submits that the total quantum of recovery in the present case is 1.995 Kgs. of Brown Sugar and the prosecution has relied upon 8 witnesses. Date of charge has been fixed before the learned Special Court. Having considered the quantum of recovery in the present case, I am of the opinion that the rigors of Section 37 of the NDPS Act is attracted. As such, prayer for bail of the petitioner in CRM (NDPS) 1455 of 2026 is rejected. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. 2 Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
