Rakib (Allowed) CRM (M) 1178 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Saktipur Police Station case no. 241 of 2015 dated 14.01.2015 under Sections 302 of the Indian Penal Code, 1860. And In the matter of : Buddhadeb Mondal ……Petitioner. Ms. Rajashree Venket Kundalia .....for the Petitioner. Mr. Rajendra Banerjee, Ld. APP Mr. Suman Chakraborty ……for the State. Leave is granted to the petitioner to correct the cause title. The correct case number should be ‘Saktipur Police Station case no. 241/2015 dated 14.11.2015’. Name of the father of the present petitioner is also incorrectly incorporated, the same should be ‘Late Tribhanga Mondal’ instead of ‘Late Bidhan Mondal’. Learned advocate appearing for the petitioner submits that the petitioner was arrested on 15.11.2025 and since then he is custody. Mr. Rajendra Banerjee, learned Additional Public Prosecutor along with Mr. Suman Chakraborty appears for the State. Their appointments may be regularized by the concerned authorities. Report submitted by the State reflects that out of 26 witnesses 11 witnesses have been examined till date. 2 As some more time is required to take the trial to its logical conclusion, without entering into the merits of the case, I am inclined to release the petitioner on bail. Accordingly, the petitioner, namely, Buddhadeb Mondal shall be released on bail by furnishing bond subject to the satisfaction of the learned Additional Sessions Judge, FTC-3, Berhamore, Murshidabad. If on bail, the petitioner shall ensure he is present physically on each and every date before the learned trial Court. Thus, CRM (M) No. 1178 of 2026 is allowed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
