By means of this writ petition, petitioner has sought the following reliefs: “i. issue a writ, order or direction in the nature of mandamus commanding and directing the respondents to pay the arrear of ACP to the petitioner from the due date along with 18% interest till the actual payment is being made by the respondent authority towards the arrears of ACP. ii. Issue a writ, order or direction in the nature of mandamus commanding and directing the respondents to count the past services of the petitioner for the purpose of selection grade, promotional scale and post retirement benefits including pension, etc, from respective date of appointment of the petitioner i.e. 01-05-1994.” 3. Learned counsel for the petitioner submits that 1st and 2nd ACP has been granted to the petitioner; however, 3rd ACP has not been sanctioned even though petitioner is due for such benefit. 4. Learned State Counsel, however, submits that whatever benefit was due to the petitioner, has been granted. Thus he submits that nothing remains to be released to the petitioner. 2026:UHC:1034 5. Having regard to the facts of the case, the writ petition is disposed of with liberty to petitioner to make representation regarding 3rd ACP. If he makes representation within ten days from today, decision thereupon shall be taken, as per law, within six months thereafter.
