The petitioner is apprehending his arrest in connection with Complaint Case No.1345 of 2022, for offence registered under section 33 of Indian Forest Act, 1927, pending in court of learned Chief Judicial Magistrate, Chatra. 3. Learned counsel for the petitioner submits that the dispute is with regard to the land and allegations are made that in the protected forest area, the petitioner and one another were constructing church on the forest land. She next submits that the another person died in the year 2000. 4. Learned State counsel opposes prayer and submits that the allegations are there of utilizing forest land for construction of church. 5. Considering that the dispute is with regard to the forest land and another person has died in the year 2000 whereas the case has been lodged in the year 2022, and in that view of the matter, the petitioner, above named, is, hereby, directed to surrender before learned court within two weeks from today, and learned court shall release the petitioner, above named, on such terms and conditions as well as sureties as the learned court may deem fit and proper. 6.
