Learned advocate for the petitioner submits that the independent witnesses have been declared hostile in the present case and from 5 persons there has been alleged recovery of 148 Kgs. of Ganja. Petitioners are in custody for a period of 10 months. As such they may be granted bail.
Learned advocate for the State opposes the prayer for bail and submits that seizure was videographed and there is a videographer on whom the prosecution has relied upon. The videographer has been cited as CSW 16 in the charge sheet.
Having considered the same, I direct the learned Trial Court to prepone the evidence of CSW 16 and complete his evidence within a period of 3 months from the date of communication of this order.

At this stage, the prayer for bail of the petitioners in CRM (NDPS) 1461 of 2026 is rejected.
Petitioners would renew their prayer for bail after the evidence of the videographer (CSW 16) is over.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
