Learned advocate appearing for the petitioners submits that the present case was initated because of issues relating to matrimonial dispute and the present petitioner no.1 is the mother- in-law and the petitioner no.2 is the brother-in-law. Learned advocate for the State has produced the case diary and opposed the prayer for anticipatory bail. I have taken into account the nature of complaint and the necessity of custodial interrogation. Having regard to the overall circumstances, presently I am of the opinion that custodial detention of the petitioners may not be warranted. As such, the prayer for anticipatory bail of the 2 petitioners is allowed. Accordingly, in the event of arrest, the petitioners, namely, Mrs. Sunita Jangid and Mr. Hemant Chandan Jangid shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. However, as the investigation of the case is still in progress, I direct the petitioner no.2, namely, Mr. Hemant Chandan Jangid to make himself available before the investigating officer of the case by 5th August, 2026. Thereafter, the investigating officer if he requires he will fix subsequent dates till submission of the charge-sheet. With the aforesaid observations, CRM(A)1777 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
