Learned advocate for the petitioners submits that the subject-matter of the instant case relates to alleged recovery of 21 kg of ganja. The petitioners are in custody for more than six months; charge-sheet has already been submitted before the learned jurisdictional court. Learned advocate, as such, prays that the petitioners may be released on bail on any stringent condition. Learned advocate for the State opposes the prayer for bail. The records of the case reflect that the prosecution has relied upon 18 witnesses in order to prove its case. Having considered the same and the period of detention of the present petitioners, I am inclined to enlarge the petitioners on bail.
2 Hence, the prayer for bail of the petitioners is Allowed. Accordingly, the petitioners viz, Ishadur Ali and Hari Barman shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only) each, with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under NDPS Act, 3rd Court, Malda. If on bail, the petitioners shall also make themselves physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of Malda without prior permission of the learned Special court/trial court. Accordingly, CRM (NDPS) 1450 of 2026 is allowed. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
