As per the case of the prosecution, the complainant, an illiterate woman namely Rambati resident of village Chilkuti-Kurandi, has lodged a report with the concerned Police Station stating that on 3.6.2014, the applicant, along with co-accused Mahendra Mahapatra and Jabbar Khan took advantage of her illiteracy to fraudulently prepare fake documents and executed a registered sale deed of her ancestral land. The disputed property involves Khasra No.472, ad measuring 0.61 hectares. The complainant has stated that she never actually sold the land, nor did she receive the alleged sale consideration amount of Rs.5,11,000/-. Thereafter FIR has been registered against the applicant and other co-accused persons. Hence, the bail application. 3. Learned counsel for the applicant submits that the applicant is innocent and has falsely been implicated in the present case. He further submits that there is inordinate and unexplained delay of 11-12 years in lodging the FIR and dispute between the parties is purely civil in nature. He further submits that the applicant has paid an amount of Rs.5,11,000/- in cash to the complainant. Hence he prays to enlarge the applicant on anticipatory bail. 4. On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submits that the applicant has two criminal antecedents registered against him under the IPC and 3 BNS and the complainant being widow lady has been cheated. Therefore, the anticipatory bail application of the applicant deserves to be rejected. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the nature of allegation made against the present applicant that the applicant along with co-accused persons has cheated the complainant, who is widow lady, and has paid an amount of Rs.5,11,000/- in cash, but no documentary evidence was annexed to show that any such payment was ever made and that he has two criminal antecedents registered against him under Section 420/34 IPC and under Sections 3 (5), 318 (4), 336 (3), 338, 340 (2) of the BNS, I am not inclined to grant anticipatory bail to the applicant. 7. Accordingly, the anticipatory bail application of the applicant - Pinku Ghosh, involved in Crime No.110/2025, registered at Police Station Nagarnar, District Bastar (C.G.) for alleged commission of offence punishable under Sections 420, 467, 468, 471, 120-B of the IPC, is rejected.
