Learned counsel for the applicants would submit that due to inadvertence, on the date fixed for hearing, i.e., 08.01.2026, when the matter was taken up after pass-over, the counsel engaged in MAC No.1440 of 2024 could not reach the Court in time. Consequently, the case was dismissed for want of prosecution; thus, she would pray that the matter may be restored to its original number. 3. On the other hand, learned counsel appearing for the non-applicants would oppose the submission made by counsel for the applicant. 4. Heard. 5. Taking into consideration the submission made by counsel for the applicants and reason assigned in the application, the instant MCC is allowed and the MAC No.1440 of 2024 is restored to its original number.
