Order On Board 29.7.2026 1) By way of this petition, the petitioner has sought following reliefs:- 10.1 That, this Hon'ble Court may kindly be pleased to issue a writ of mandamus to quash the Annexure P-1, further writ of mandamus may kindly be issued commanding to the respondents to give benefit of salary increment and others by counting the petitioner as permanent employee.
2 10.2 That, any other relief which this Hon'ble Court deems fit and proper in favor of the petitioner may kindly be passed. 2) Learned counsel for the petitioner submits that petitioner was appointed to the post of Inspector (Legal Metrology) under the respondent department 23.12.2013 and till date, his services have not been confirmed on account of pendency of criminal case. He further submits that learned Special Judge (P.C. Act), Rajnandgaon has acquitted the petitioner vide judgment dated 29.6.2026 passed in Special Case (P.C. Act ) No. 1/2026. He also submits as the criminal case has been decided, respondent authorities may be directed to consider the claim of petitioner with regard to confirmation of services at the earliest. 3) On the other hand, learned State counsel would oppose. 4) Heard. 5) Taking into consideration the submission made by Mr. Tiwari to the effect that criminal case lodged against the petitioner has culminated into acquittal, this petition is hereby being disposed reserving liberty in favor of petitioner to make a representation before the respondent No. 2, who in turn is directed to take appropriate decision with regard to confirmation of services preferably within period of 45 days from the date of receipt of copy of such representation. 6) It is expected that the authority concerned shall take note of the

judgment dated 29.6.2026 passed by the competent criminal court and further the fact that petitioner has already completed two years of service with the department. 7) With the aforesaid direction, this writ petition stands disposed.
