Learned advocate appearing for the petitioners submits that the petitioner no.1 is in custody for 2 years 3 months and the petitioner no.2 is in custody for 1 year 6 months and till date there has been no progress in the case. Learned advocate for the State opposes the prayer for bail and submits that out of 16 witnesses 13 witnesses have been examined. Having considered that the petitioner no.1 is in custody for a considerable period of time, I direct the learned trial court to complete rest of the witnesses within a period of four months from date. In case learned trial court for reasons beyond its control cannot complete the trial within aforesaid time period, the learned 2 trial court would release the petitioners on bail, if the accused persons do not contribute to the delay. At this stage, the prayer for bail of the petitioners are rejected. Learned trial court would adhere to the directions passed above. Consequently, CRM(NDPS)1375 of 2026 is disposed of. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
