JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 3 19-08-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. Petitioner seeks regular bail in connection with Chandi P. S. Case No. 109 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 110, 303(2), 117(2), 117(3), 117(4), 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita. 3. As per prosecution case, on 30.6.25 at about 2 PM, when informant along with his brother was returning home, all the F.I.R. named accused persons, armed with weapons, surrounded and brutally assaulted them. It is further alleged that when Usha Devi came to save them, she was also assaulted by the accused persons and they also snatched Rs. 1,50,000/- cash Patna High Court CR. MISC. No.41880 of 2026(3) dt.19-08-2026 2/2 and gold chain from the brother of informant. 4. Learned counsel for the petitioner submits that both parties are agnates and dispute over measurement of land led to maar-peet in which both sides sustained injuries. Allegation of assault is general and omnibus. Case and counter case. Petitioner is in custody since 24.04.2026. Charge-sheet has already been submitted. 5. However, learned A.P.P. for the State vehemently opposed the bail application. 6. Considering the nature of accusation, case and counter case and period of custody, this bail application is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Chandi P.
