In view of the fact that no narcotic substance has been recovered from the possession of the petitioner and his name has transpired from the statement of the co-accused, the petitioner has been able to rebut the statutory restriction under Section 37 of the NDPS Act. Therefore, he is entitled to bail. Accordingly, the prayer for bail is allowed. The petitioner namely Anichur Rahaman @ Anichul Islam @ Bapi shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of like amount each, one of whom must be local to the satisfaction of the learned 2 Additional Sessions Judge, 1st Court under the NDPS Act, Cooch Behar subject to condition that he shall remain within the jurisdiction of the learned trial Court and shall appear before the learned trial Court on every date of hearing fixed by the learned trial Court. He shall not tamper with evidence or intimidate witnesses in any manner whatsoever. In the event the petitioner fails to adhere to any of the conditions stated hereinabove, the learned trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
