The present petition has been filed by the petitioner under Articles 226/227 of the Constitution of India, seeking a writ of certiorari, for quashing/setting aside the finance circular No.3/1/2021- 3FPPC/276 dated 29.10.2021 (Annexure P-4), issued by the Government of Punjab, Department of Finance, for the revision of pension of pre-01.01.2016 retiree pensioners/family pensioners, as the same being contrary to the recommendation of the 6th Punjab Pay Commission, which was duly approved by the Government of Punjab and notified on 05.07.2021 (Annexure P-3) known as Punjab Civil Services (Revised Pay) Rules, 2021. Further, a writ of mandamus has been sought for directing the respondents to revise the pension of the petitioner, who is pre-01.01.2016 retiree pensioner, in accordance with the recommendation of the 6th Punjab Pay Commission by applying the multiplying factor of 2.59 on the existing pension as on 01.01.2016. Learned counsel for the petitioner submits that similarly situated persons, like the present petitioner, had earlier approached this Court by way of filing various writ petitions and the lead case bearing CWP No.19245 of 2025 titled as 'Nirmal Singh Dhanona v. State of Punjab and others', decided on 29.01.2016 (Annexure P-7) and in the said case the following directions have been issued:-
“12. In view of the above, all the aforementioned writ petitions are disposed of in the following terms: (i) The Empowered Committee constituted under the Punjab Litigation Policy is hereby directed to treat these writ petitions as a comprehensive representation and to consider and adjudicate upon the issue raised herein. In the alternative, the petitioner(s) shall be at liberty to submit their respective detailed representation(s) setting out their claim(s) within a period of two weeks from the date of receipt of a certified copy of this order. (ii) The Committee shall pass a reasoned and speaking
order, after granting an opportunity of personal hearing to the petitioner(s), within a period of four months from the date of receipt of certified copy of this order, or from the date of receipt of the representation of the petitioner(s), as the case may be. Further, the decision taken thereon shall be conveyed to the petitioner(s). Needless to say, if the petitioner(s) are found entitled to the relief sought, the same shall be granted to them forthwith.”

On receipt of advance copy, learned State counsel submits that the claim of the petitioner, as raised in the legal notice dated 06.03.2026 (Annexure P-6), shall be considered and decided by the Empowered Committee along with other cases of the other similarly situated employees after granting an opportunity of hearing in terms of the directions issued by this Court in the aforesaid judgment, within a period of three months.
