Ms. Tanusree Kar. …for the State. Learned advocate appearing for the petitioner submits that there were two cases which have registered being Nandigram P.S. Case No.232 of 2025 and Nandigram P.S. Case No.231 of 2025. Both the cases were registered in respect of the same incident. So far as Nandigram P.S. Case No.231 of 2025 is concerned, the petitioner was arrested and he was in custody for 74 days and thereafter he has been released on bail. So far as the present case is concerned, the petitioner was not arrested at the relevant point of time and prays for anticipatory bail. Learned advocate for the State submits that the present case has been initiated at the instance of the mother of the deceased. In respect of the other case on selfsame facts the same 2 was initiated by the police authorities. Having considered that on the selfsame facts two cases were registered, I am inclined to extend the benefit of anticipatory bail to the present petitioner. As such, his prayer for anticipatory bail is allowed. Accordingly, in the event of arrest, the petitioner, namely, Ganesh Mondal shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the charge-sheet has already been submitted before the jurisdictional court, this order of anticipatory bail will remain in force for a period of six weeks. Accordingly, CRM(A)1584 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
