Maiti …for Air Customs authority. Learned advocate appearing for the petitioner submits that the alleged recovery in the present case is around 1 kg. of Ganja. Complaint has already been submitted before the jurisdictional Court. As such, the petitioner be released on bail. Learned advocate for the Air Customs Authority opposes the prayer for bail. Relying on the judgment of Barnali Bag versus Union of India (Special Leave Petition (Crl.) No. 3641 of 2026, I am inclined to release the petitioner on bail as in the ratio therein there is emphasis on the quantity of seizure. Thus, prayer for bail of the petitioner is allowed. 2 Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of learned Judge, NDPS Act, 8th Court, Barasat. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District North 24 Parganas without the prior permission of the learned Special Court. Additionally, the petitioner shall be himself available before the Investigating Officer or any Officer assigned by the Principal Commissioner, Air Customs as and when called for. Accordingly, CRM (NDPS) 1494 of 2026 is allowed. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
