Maiti … for the Air Customs Authority Learned advocate for the petitioner submits that the petitioner was arrested on or about January, 2026 for alleged recovery of 8031 gm of ganja from the joint possession of the petitioner and another. Mr. Banerjee, learned advocate, appears for the Air Customs Authority along with a junior of his choice. The appointment of both Mr. Banerjee and the junior of his choice, if any, be regularized by the concerned authority. Learned advocate for the Air Customs Authority opposes the prayer for bail. Having considered that the judgment of Hon’ble Supreme Court in [Barnali Bag –v- Union of India (SLP [Crl.] No. 3641 of 2026] is applicable in the present case where 2 emphasis was made on intermediate quantity, I am inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Sameer Rahim Halani shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under NDPS Act, 8th Court, Barasat, North 24 Parganas. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of North 24 Parganas without prior permission of the learned Special court/trial court. Additionally, the petitioner shall make himself physically available as and when called for by the Investigating Officer of the case as well as any officer assigned by the Principal Commissioner of the Air Customs Authority. Accordingly, CRM (NDPS) 1434 of 2026 is allowed.
