1. Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 80 and 3(5) of the BNS. 3. Learned counsel appearing on behalf of the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that her daughter was married to the petitioner on 09.05.2025, further after marriage, accused persons including the petitioner were demanding a motorcycle and Rs. 2 lakhs along with a gold chain, on account of non-fulfillment of the dowry demand the victim was tortured, further panchayati was convened several times but the issue was not pacified, it is next alleged that the victim became pregnant

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case being husband of the deceased. It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that informant is not an eye-witness to the occurrence and allegation of demand of dowry and torture is general and omnibus in nature, it is next submitted that petitioner works at Bengaluru and the postmortem report records the cause of death as asphyxia on account of hanging which amply demonstrates that victim committed suicide. 5.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and submits that what is not in dispute rather stands admitted is that victim died within 7 years of marriage, as such presumption in law is against the husband and his family members, it is next submitted that even presuming what has been submitted by the learned counsel appearing on behalf of the petitioner to be true that petitioner was working at Bengaluru and was not present at the place of occurrence when the occurrence took place, but then the petitioner being husband created condition conducive for the

After hearing learned counsel for the parties and taking into consideration the submissions made by the learned A.P.P. for the State, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner. 7.
