1. Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner seeks bail in anticipation of his arrest in Shastri Nagar P. S. Case No.422 of 2026 registered for the offences punishable under Sections 316(5), 318(4) and 3(5) of the B.N.S.

The learned counsel appearing on behalf of the petitioner submits that petitioner is a person with clean antecedent and is a Data Entry Operator and the informant alleges that information was received regarding large scale financial irregularities and embezzlement of government fund under Ayushman Bharat Scheme at IGIMS. It is next alleged that some patients were shown as cash paying patients instead of beneficiaries under the Scheme resulting in wrongful gain and

Further, based on complaint, an Enquiry Committee was constituted which in its interim report prima facie found evidence of embezzlement and misuse of government fund. Further, in the enquiry, several persons were examined associated with the Scheme and four persons namely, Amarjeet Raj, Chandan Kumar, Saket Kumar (petitioner) and Abhishek Kumar were found involved through fraudulent insurance claim, fake medical bills, forged documents, diversion of reimbursement and manipulation of hospital beneficiary records. It is also alleged that the aforesaid accused persons, during the enquiry, admitted their involvement in the misconduct in their written statement. Further, the exact embezzled amount cannot be determined and involvement of other accused persons cannot be ruled out. 4. The learned counsel for the petitioner, after some argument, seeks permission to withdraw the present anticipatory bail application with liberty to the petitioner to surrender and seek regular bail. 5.
