C.R.M. (NDPS)1412 of 2026
In Re: An application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with NDPS Case No.98 of 2025 arising out of NCB Crime No.12/NCB/KOL/2025 dated 04.06.2025 under Sections 8(c) read with Sections 20(b)(ii)(C)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985;
Ainal Sk. Versus Union of India
Mr. Tapodip Gupta Ms. Usashi Chattopadhyay. …for the petitioner.
Mr. Himanshu De Mr. R.R. Mohanty. …for the NCB.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 8 months and he has been shown arrested in connection with the instant case although he is innocent of the charges.
Learned senior advocate appearing for the NCB opposes the prayer for bail as there has been recovery of 112.5 kgs of ganja in the present case. Although the petitioner has been innocent and has been arrested only on the statement of the co- accused, but learned advocate for the prosecution submits that there are call data records which revealed the connection of the present petitioner with the other accused persons.
Having considered the plea of the respective parties and
2 the huge quantum of seizure, I am not inclined to release the petitioner on bail.
Accordingly, the prayer for bail of the petitioner in CRM(NDPS)1412 of 2026 is dismissed.
