2.
Learned Counsel for the petitioner has inter alia argued that the petitioner sustained gunshot injury on his leg/knee in the alleged encounter allegedly taking place on 26.09.2025 which gave birth to the above mentioned FIR; that consequent thereto, the petitioner was shifted to a hospital and was subjected to treatment/surgical intervention and metallic plates/rods were implanted in his knee joint coupled with multiple external VINAY MAHAJAN 2026.07.15 18:12 I attest to the accuracy and integrity of this document

Per contra, learned State Counsel has opposed for grant of interim bail to the petitioner. However, while referring to para 16 of the Status report dated 10.07.2026 filed by her today in the Court, she concedes that the petitioner has been shown in the said report to be on a wheel chair on account of a metallic external fixator applied to his right leg.
She in fact has opposed the said interim bail on the ground that outcome of Pus Culture sensitivity test is awaited from DDU Hospital. VINAY MAHAJAN 2026.07.15 18:12 I attest to the accuracy and integrity of this document

4. The said opposition shows that pus was detected in alleged injury of the petitioner and fixator has been applied to the same. The petitioner has already been granted interim bail for a period of 02 weeks from the date of his release in the murder FIR in which the petitioner was being tried to be apprehended when the occurrence in question took place. If the status report filed in the court today is perused in its substance, it conveys that the medical condition of the petitioner requires immediate attention. 5. Therefore, the petitioner on his furnishing bail bond in the sum of Rs.2,00,000/- (rupees two lacs only) with two sureties in the like amount to the satisfaction of the concerned trial Court/CJM/Area Magistrate/Duty Magistrate, is ordered to be released on interim bail in the FIR/case in question for a period of 02 weeks from the date of his release with a condition that as undertaken by his counsel, the petitioner will not apply for extension of interim bail granted to him today in the matter in question. On expiry of the said 14 days, he will surrender before the concerned jail authorities. 6. Petition is disposed of accordingly. 7. All interim applications, if any, also stand disposed off.
