This writ petition alleges inaction on the part of the respondent WBSEDCL Authorities in shifting the meter through which electricity is being supplied to the respondent no.8. 2. The petitioners contend that electricity is being supplied to the respondent no.8 through a meter that has been installed in the portion of the premises which is under the occupation of the petitioners. It is submitted that since electricity is being supplied to the respondent no.8, who claims to be a tenant in respect of the premises, the meter should be shifted to the same place which is under occupation of the respondent no.8. 3. Learned Advocate appearing for the respondent no.8 submits that electricity was 2 supplied to the respondent no.8 upon consent being given on behalf of the petitioners through the petitioners’ learned Advocate before the District Magistrate, Purba Bardhaman during the hearing taken on December 10, 2024 pursuant to an order passed by a co-ordinate Bench of this Court in WPA 19225 of 2024. 4. It is further submitted that the respondent no.8 is only in occupation of one room where installation of meter may not be feasible. 5. Mr. Mukherjee, learned Advocate appearing for the respondent WBSEDCL Authorities submits that the petitioners have never applied to the appropriate authority of the WBSEDCL for the purpose of shifting of meter. It is further submitted that meters are installed at the existing meter board position where, the service line finds vent in the premises in question. It is submitted that the Station Manager, Burdwan Sector I, WBSEDCL has been wrongly described as the Station Manager, Burdwan Section IV in the cause title of the writ petition. 6. It is also submitted that in the case at hand, electricity supply has been effected to the respondent no.8 in terms of the order dated 3 December 10, 2024 passed by the District Magistrate, Purba Bardhaman. 7. Having heard the learned Advocates appearing for the respective parties and having considered the material-on-record, this writ petition is disposed of by granting liberty to the petitioners to make an application before the Station Manager, Burdwan Sector-I, WBSEDCL with a request for shifting of the meter through which electricity is being supplied to the respondent no.8. 8. If such an application is made the said Station Manger, Burdwan Sector-I WBSEDCL shall consider and dispose of the same, in accordance with law within a period of four weeks from the date of making of such application either by shifting or by passing a reasoned order stating why shifting cannot be done. 9. It is made clear that this order shall not be treated as a mandate to shift the meter from the place where it is presently installed to the portion under occupation of the respondent no.8. 10. The Station Manager, Burdwan, Sector-I WBSEDCL shall be absolutely free to take a decision in accordance with law and the relevant regulations keeping in view the safety aspect as 4 well as the regulatory norms in place. If it is found that shifting of meter is technically not feasible or it is risk fraught, the same would not be done. However in such case a reasoned intimation should be given to the petitioner as aforesaid. 11. With the above observations WPA 19264 of 2025 stands disposed of. There shall be no order as to costs. 12. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
