Learned advocate appearing for the petitioner submits that the total recovery in the present case is 6.433 kgs. of Ganja. Complaint has already been submitted before the jurisdictional Special Court. Learned advocate for the NCB opposes the prayer for bail. Having considered the judgment of Barnali Bag versus Union of India (Special Leave Petition (Crl.) No. 3641 of 2026, wherein emphasis was made on intermediate quantity, I am of the view that the petitioner is covered by the ratio of the said judgment. Thus, prayer for bail of the petitioner is allowed. Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of 2 Rs.10,000/- each, one of whom must be local to the satisfaction of learned Judge, NDPS Act, 6th Court, Barasat, North 24 Parganas. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District North 24 Parganas without the prior permission of the learned Trial Court. Accordingly, CRM (NDPS) 1474 of 2026 is allowed. Memo of evidence filed by the State is taken on record.
