IN THE HIGH COURT OF JUDICATURE AT PATNA CRIMINAL MISCELLANEOUS No.58920 of 2026 Arising Out of PS. Case No.-122 Year-2026 Thana- KARAI PARSURAI District- Nalanda ====================================================== Dhalendra Kumar, S/O Late Ranjit Prasad @ Ranjit Yadav, R/O Village- Hajipur Dumri, Police Station- Fatuha, District- Patna ... ... Petitioner/s Versus The State of Bihar ... ... Opposite Party/s ====================================================== Appearance : For the Petitioner/s : Mr.Anil Kumar Singh, Adv. For the Opposite Party/s : Mr.Bhanu Pratap Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 2 19-08-2026 Heard the parties. 2. The petitioner seeks regular bail in connection with Karaiparsurai P. S. Case No. 122 of 2026, registered for the offence punishable under Section 309(4) of the BNS. 3. The main submissions advanced by learned counsel for the petitioner are that the petitioner has no criminal antecedents and has been languishing in jail since 29.06.2026 and he has been made an accused mainly on the basis of the confessional statement of co-accused Sutil Yadav, who happens to be the cousin brother of the petitioner. However, in the light of his own statement, the petitioner is stated to be the owner of the motorcycle bearing registration No. BR01SH-3612, which is alleged to have been used by the accused persons in the commission of the alleged loot. In respect of the petitioner's Patna High Court CR. MISC. No.58920 of 2026(2) dt.19-08-2026 2/2 involvement in the commission of the alleged loot, the prosecution is mainly relying upon the statement of co-accused Sutil Yadav, even if the said statement is taken to be true, it does not reveal any participation on the part of the petitioner in the commission of the alleged loot, thus, the main basis for implicating the petitioner appears to be his ownership of the alleged motorcycle. 4. Learned APP appearing for the State has opposed the bail prayer of the petitioner. 5. Considering the aforesaid submissions and mainly taking note of the petitioner's fair and clean antecedents, his period of custody and the statements made by him in paragraph nos. 8, 9 and 10 of the petition, this Court is inclined to grant the relief of regular bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Karaiparsurai P. S. Case No. 122 of 2026 on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned. Rajiv/- (Shailendra Singh, J) U T
