JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused in Crime No.155/2026 registered by Amruthahalli Police Station, Bengaluru City, for the offence punishable under Section 108 of Bharatiya Nyaya Sanhita, 2023, is before this Court in this criminal petition filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.155/2026 was registered by Amruthahalli Police Station, Bengaluru City, for the aforesaid offence against the petitioner on the basis of the first information dated 24.05.2026 received from - 3 - HC-KAR CNR: KAHC010466362026 NC: 2026:KHC:36499 CRL.P No. 10079 of 2026 Sri.Ashok Kumar S/o Harilal Mehta, who is uncle of deceased-Manisha Prasad. During the course of investigation, the petitioner was arrested on 02.06.2026 and subsequently remanded to judicial custody. His bail petition filed before the jurisdictional Sessions Court in Crl.Misc.No.5862/2026 was rejected on 02.07.2026. Therefore, the petitioner is before this Court. 4. Learned counsel for the petitioner having reiterated the grounds urged in the petition, prays to allow the petition. 5. Per contra, learned High Court Government Pleader has opposed the bail petition and prays to dismiss the petition. 6. A reading of the first information dated 24.05.2026 would reveal that deceased-Monisha Prasad was the daughter of the elder sister of the first informant's wife. It appears that marriage of the deceased-Manisha Prasad had failed. In the year 2024 she had divorced her - 4 - HC-KAR CNR: KAHC010466362026 NC: 2026:KHC:36499 CRL.P No. 10079 of 2026 husband and thereafter was living alone in Mumbai. In the month of April 2026, she had purchased an apartment near Manyatha Back Gate, Bengaluru. On 23.05.2026, she had hanged herself in the bedroom of the aforesaid apartment, leaving behind a death note stating that the petitioner was responsible for her death. Except stating that petitioner was responsible for her death and also leaving behind his mobile phone number, the deceased has not mentioned anything in her death note. The petitioner is in custody in the present case from 02.06.2026. Major portion of investigation is already completed. Considering the nature of allegation and the fact that major portion of the investigation is already completed, I am of the opinion that without expressing any opinion on the merits/demerits of the case, the prayer made by the petitioner for grant of regular bail is required to be answered affirmatively. Accordingly, the following:- ORDER (i) The petition is allowed. - 5 - HC-KAR CNR: KAHC010466362026 NC: 2026:KHC:36499 CRL.P No. 10079 of 2026 (ii) Petitioner is directed to be enlarged on bail in Crime No.155/2026 registered by Amruthahalli Police Station, Bengaluru City, for the offence punishable under Section 108 of the Bharatiya Nyaya Sanhita, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) Petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) Petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) Petitioner shall not involve in similar offences in future; and - 6 - HC-KAR CNR: KAHC010466362026 NC: 2026:KHC:36499 CRL.P No. 10079 of 2026 e) Petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
