Learned advocate appearing for the petitioner submits that petitioner is in custody for two years seven months and although, there was a direction to complete rest of the witnesses but till date only 12 witnesses have been examined. Learned advocate appearing for the State opposes the prayer for bail. I have taken into account the evidence of one of the witness which requires re-consideration by this Court. So far as the other witness is concerned in the seizure list namely, Imran Biswas, he has not been cited as a witness in the charge-sheet, other witnesses are belonging to the police department. Having considered the time period which has lapsed of two years seven months and that another 14 witnesses are to be examined by the prosecution, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed.
2 As such, the petitioner, namely, Piroj Bagha shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court (under NDPS Act), Nadia, Krishnanagar. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of Nadia without prior permission of the learned Special Court. Thus, CRM (NDPS) No. 1358 of 2026 is allowed. Memo of the evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
