C.R.M. (NDPS)1411 of 2026
In Re: An application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with NDPS Case No.172 of 2025 arising out of NCB Crime No.18/NCB/KOL/2025 (NCB Crime No.18 of 2025) dated 23.09.2025 under Section 8(c) read with Sections 20(b)(ii)(C)/25/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985;
Ainal Sk. Versus Union of India
Mr. Tapodip Gupta Ms. Usashi Chattopadhyay. …for the petitioner.
Mr. Himanshu De Mr. R.R. Mohanty. …for the NCB.
Learned advocate appearing for the petitioner submits that the quantum of seizure in the present case is 150.864 kgs. of ganja. However, petitioner is innocent as the petitioner was bystander who was implicated in the present case.
Learned senior advocate appearing for the NCB opposes the prayer for bail in view of the huge quantity of seizure effected.
Having considered that the plea raised by the present petitioner is a question of fact, at this stage, I am not inclined to release the petitioner on bail.
Accordingly, the prayer for bail of the petitioner in CRM(NDPS)1411 of 2026 is dismissed.
