1. By way of this petition, the petitioner has prayed for following reliefs:-
“10.1 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ, order or direction, preferably in the nature of Certiorari, quashing and setting aside the impugned order dated 21.07.2026 (Annexure P/1) passed by the respondent No.3/Sub-Divisional Magistrate, Bilaspur. 10.2 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ, order or direction, preferably in the nature of Mandamus, directing the respondents grant permission to the petitioner to organize the birthday celebration of actor Sanjay Dutt on 29.07.2026 at the Hall situated on the 3rd Floor of Sagar Shikhar Complex, Madhya Nagri Chowk, Bilaspur, subject to such reasonable conditions as this Hon'ble Court may deem fit and proper. 10.3 That, the Hon'ble Court may kindly be pleased to grant any other relief, as it may deem-fit and appropriate.”
2. Learned counsel for the petitioner submits that the present petition has been filed seeking appropriate directions for grant of
3 permission to celebrate the birthday of renowned actor Sanjay Dutt on 29.07.2026. It is submitted that the petitioner had submitted an application before the competent authorities seeking the requisite permission; however, the same came to be rejected by order dated 21.07.2026 passed by the Sub-Divisional Magistrate, Bilaspur. The rejection is primarily founded on the allegation that, on an earlier occasion, the petitioner had celebrated the birthday of actor Sanjay Dutt on a public road at Madhya Nagri Chowk, Bilaspur, which allegedly resulted in disturbance to public peace, order, and tranquility in the area.
Learned counsel submits that the said reasoning is wholly misconceived and cannot be made the sole basis for refusing permission on every subsequent occasion. It is further contended that the petitioner has now proposed to celebrate the birthday at The Country Club, Koni, Bilaspur, which is situated approximately 7 kilometres away from Bilaspur city, in a private and covered premises. It is further submitted that the proposed celebration shall be conducted in a peaceful and orderly manner without causing any obstruction to traffic, inconvenience to the general public, or disturbance to law and order. The petitioner further undertakes to abide by all the terms and conditions that may be imposed by the competent authorities and to strictly comply with all applicable statutory provisions, rules, regulations, and administrative directions. On these submissions, it is prayed that the impugned order dated 21.07.2026 be quashed and the
4 respondents be directed to grant the necessary permission for holding the proposed celebration.

Per contra, learned counsel appearing for the State submits that the petitioner was denied permission in view of his previous conduct, wherein the celebration was allegedly organized on a public road, thereby affecting public peace and tranquility. However, upon instructions, it is fairly submitted that if the petitioner now proposes to organize the celebration at The Country Club, Koni, Bilaspur, which is a private enclosed venue, and furnishes an undertaking that he shall strictly adhere to all the conditions imposed by the competent authorities, maintain law and order, and shall not violate any statutory provisions, rules, or regulations, the State has no serious objection to the competent authority reconsidering the petitioner's request in accordance with law.
4. I have heard learned counsel for the parties and perused the material available on record.
5. Having heard learned counsel for the parties and considering the
facts and circumstances of the case, particularly the fact that the petitioner now proposes to celebrate the birthday function of actor Sanjay Dutt at The Country Club, Koni, Bilaspur, which is a private covered premises situated away from the city, and has undertaken to maintain peace, law and order, and to strictly abide by all statutory provisions, rules, and regulations, this Court deems it appropriate to permit the petitioner to organize the said
5 celebration on 29.07.2026. Accordingly, the petitioner is permitted to hold the proposed birthday celebration at the aforesaid venue, subject to the condition that the petitioner shall strictly comply with all applicable laws, rules, regulations, and any conditions imposed by the competent authorities for maintaining public peace and tranquilities. He further under rules not to violate any rule, regulation in respect of noise, environment pollution as well as hindrance in public convenience. He is strictly prohibited to make any obstruction on public root. In the event of any violation of the aforesaid conditions, it shall be open to the respondent authorities to take appropriate action in accordance with law.
