Mr. Chanderhas Yadav, Advocate for the complainant. **** JASJIT SINGH BEDI, J. The present appeal has been preferred against the judgment dated 25.02.2026 passed by the Addl. Sessions Judge, Jhajjar in case bearing FIR No.07 dated 08.01.2026 registered under Sections 115, 351(3), 110, 3(5) of BNS and 3(1)r, 3(1)s, 3(2)(va) of SC/ST Act (Section 109(1) of BNS, 2023 added later on) at P.S. Beri, , District Jhajjar, Haryana, dismissing the bail petition of the appellant. 2. The learned counsel for the appellant contends that the specific injury on the head of Akash (injured) has been attributed to Monu alias Chintu, though there is a reference that Kapil and Dinesh (petitioner) also struck him on the head with a bat. The said fact is falsified from the MLR as per which there is only one injury on the head. As the appellant is in custody since 24.01.2026 but none of the 33 prosecution witnesses has been examined JITESH LAL 2026.07.14 11:00 I attest to the accuracy and integrity of this document CRA-S-1107-2026 -2- so far, the Trial of the present case is not likely to be concluded anytime soon and therefore, he is entitled to the concession of bail. 3. On the other hand, the learned State counsel and the learned counsel for the complainant contend that all the accused gave multiple bat injuries on the head of Akash who is unable to speak now. They, however, state that as per the MLR there is a single injury on the head of the person and the said injury has been attributed to three different persons as per the FIR and as per the statements of witnesses. 4. I have heard the learned counsel for the parties. 5. As per the FIR, a specific injury on the head of Akash (injured) has been attributed to Monu alias Chintu though omnibus allegations have been levelled against the other accused as well. Whether the accused including the petitioner are also liable for having committed the offence shall be adjudicated upon during the course of the Trial. As the appellant is stated to be in custody since 24.01.2026 but none of the 33 prosecution witnesses has been examined so far, therefore, the Trial of the present case is not likely to be concluded anytime soon. In this situation, the further incarceration of the appellant is not required. 6. Thus without commenting on the merits of the case, the present appeal is allowed and appellant-Dinesh S/o Dayanand is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate, concerned. The appellant shall appear before the police station concerned on the first Monday of every month till the conclusion of the trial and inform in writing each time that he is not involved in any other crime other than the present case. 8. If the appellant or his family members/associates make any at- tempt to contact/threaten/intimidate the witnesses in the present case, the State would be at liberty to move an application for cancellation of bail gran- ted vide this order. 9. In addition the appellant (or anyone on his behalf) shall prepare an FDR in the sum of Rs.50,000/- and deposit the same with the Trial Court. The same would be liable to be forfeited as per law in case of the absence of the appellant from trial without sufficient cause. 10. The appeal stands disposed of.
