After arguing for some time, learned counsel for the petitioner would submit that the Tehsildar has finally decided the application for partition on 06.07.2026 and the issue involved in the present writ petition has been rendered infructuous, therefore, he does not want to press the present writ petition, however, he would submit that the liberty may be reserved in favour of the petitioner to take all the defences available to him in the appeal against the order passed by the Tehsildar. 2.
