Kausik (Allowed) CRM (NDPS) 1453 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Asansol South Police Station Case No. 102 of 2026 dated 25.03.2026 under Sections 21(b)/29 of NDPS Act, 1985. And In the matter of : Nabab Ali & Anr. ……Petitioners. Mr. Apurba Kumar Datta ……for the Petitioner. Mr. Debajyoti Deb ……for the State. Learned advocate appearing for the petitioners submits that petitioners are in custody for about 4 months. Charge sheet has already been submitted and the prosecution has relied upon 10 witnesses in order to prove its case. Learned advocate for the State opposes the prayer for bail and submits that there were Call Data Records available to establish the relationship between the petitioners and the other accused. Be that as it may, having regard to the quantum of recovery and the period of detention, I am inclined to release the petitioners on bail. Accordingly, prayer for bail of the petitioners is allowed. 2 Accordingly, Petitioners, namely, (1) Nabab Ali and (2) Nawab Khan shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, under NDPS Act, 3rd Court, Paschim Bardhaman. If on bail, the petitioners shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Paschim Bardhaman without the prior permission of the learned Special Court. Thus, CRM (NDPS) 1453 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
