CORAM: HONOURABLE MR. JUSTICE HARISH KUMAR ORAL ORDER 2 07-08-2026 Heard the parties.
2. The initial challenge in the present writ petition was
directed against Letter No. 5344-Est-I dated 27.05.2026 and the consequential amended Letter No. 5406-Est-I dated 06.06.2026 issued under the signature of the Vice-Chancellor, Jai Prakash
Patna High Court CWJC No.11562 of 2026(2) dt.07-08-2026 2/3 University, Chapra, whereby, so far as the petitioner is concerned, he was deputed as Bursar in a newly created Government Degree College until further order.
3. Learned Advocate for the petitioner, however, fairly submits that during the pendency of the writ petition, the University reconsidered the matter and issued a fresh consequential Notification dated 01.07.2026, whereby the earlier decision, insofar as it related to the petitioner, stood superseded/rendered redundant and, in his place, Dr. Md. Ashdullah, Assistant Professor, was deputed as Bursar in the newly created Government Degree College. It is further submitted that the University appears to have realized that the earlier exercise had been undertaken without inviting options from the eligible Assistant Professors/Professors, and accordingly the said error was rectified by issuance of the aforesaid Notification dated 01.07.2026.
4. Learned Advocactes appearing on behalf of the State as well as the University fairly accepts the aforesaid factual position and places before this Court the Notification dated 01.07.2026, a copy whereof is taken on record.
5. Having considered the submissions advanced on behalf of the parties and taking note of the subsequent
Patna High Court CWJC No.11562 of 2026(2) dt.07-08-2026 3/3 Notification dated 01.07.2026, this Court finds that the impugned Letter No. 5344-Est-I dated 27.05.2026 and the consequential Letter No. 5406-Est-I dated 06.06.2026, insofar as they relate to the petitioner, no longer survive for
consideration, having been effectively superseded by the subsequent Notification. Consequently, the grievance raised by the petitioner stands redressed.
6. In view of the above, no further adjudication is required in the present writ petition. Accordingly, the writ petition stands disposed of.
