Heard the learned advocate, Mr. Shamit Sanyal, who is appearing virtually. 2. In an effort to convince the court that the petitioner/applicant approached the Appellate Authority within time i.e. by 28.11.2025, he filed a supplementary affidavit to the contempt application. 3. The tracking report annexed thereto does not show delivery of the petitioner’s/applicant’s appeal filed in purported compliance of the order passed in MAT 1962 of 2025 on 25.11.2024. The appeal was dispatched as per postal receipt on 27.11.2025, just the day before (28.11.2025) i.e. the last date for filing the appeal in terms of the order passed in MAT 1962 of 2025. 2 4. Tracking report in the supplementary affidavit does not show delivery of appeal to the addressee on the very next day i.e. on 28.11.2025. 5. The learned advocate for the appellant, therefore, is not in a position to make any further submissions in respect of the alleged contempt of the order dated 25.11.2025 in MAT 1962 of 2025. 6.
