JUSTICE ALOK KUMAR ORAL ORDER 3 13-08-2026 Heard learned counsel for the petitioner and the learned APP for the State. Perused the case diary. 2. The petitioner seeks bail in connection with Kalyanpur P.S. Case No. 174 of 2026, instituted for the offences under Sections 304(2), 310(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. The Prosecution case, in short, is that when the informant was returning from the market on his motorcycle, he was looted by some unknown miscreants. 4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. He further submits that the name of the petitioner surfaced in this case on the basis of confessional statement of the co-accused Abhay Kumar Singh. Learned counsel for the petitioner further submits that petitioner is in custody since 01.05.2026 and he has Patna High Court CR. MISC. No.46138 of 2026(3) dt.13-08-2026 2/3 no criminal antecedents. 5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 6. Having heard the parties and considering the aforesaid facts and circumstances of the case, taking into consideration the fact that the petitioner has clean antecedents and his name has been added in this case on suspicion and also considering the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner. 7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- ( Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Kalyanpur P.S. Case No. 174 of 2026, subject to the following conditions: (I) One of the bailors shall be the petitioner’s own or close member. (II) The petitioner shall appear on each and every date fixed during the trial and shall not remain absent on two consecutive dates without sufficient cause. (III) The petitioner shall not tamper with the prosecution evidence or influence/intimidate any witness during the course of trial. Patna High Court CR. MISC.
