The present petition has been preferred for the following relief/s: (i) for issuance of writ in the nature of Mandamus for directing and commanding the responsible. respondent authorities specially Respondent No. 8 i.e. Circle Patna High Court CWJC No.11850 of 2026(2) dt.07-08-2026 2/4 Officer, Bodh Gaya, District- Gaya Jee to consider and mutate the land of the Petitioners in their names and fix the rent by creating the Jamabandi in favour of them, appertaining to total area (6 Acre 45 + 5 acre 25 dismil) = 11 Acre 70 dismil having Old Khata No. 165 (New Khata No. 590), Old Plot No. 45, 50 and 53, (New Plot No. 119, 126 and 123), Thana No. 355, Mauza- Amwan, Police Station Bodh Gaya, under the District of Gaya Jee (Bihar) in the name of the Petitioners respectively as the petitioners are having absolute title / ownership and peaceful possession over the above mentioned properties, upon which, they have got absolute right, title and interest over the aforesaid piece of land vide judgement and decree dated 18.03.2021 and 27.03.2021 respectively passed by the Learned Sub Judge-III, Gaya in Title Suit No. 49/2021/797/2015 015 (Umesh Chandra Bhaskar Versus Trustee Shivalaya Newtapur Patna High Court CWJC No.11850 of 2026(2) dt.07-08-2026 3/4 Sewait Ramesh Giri and others). (ii) for issuance of any other order or orders for which Your Lordships may deem fit and proper in the facts and circumstances of the case. 3. The matter relates to khata no. 165, plot nos. 45, 50 and 53, mauza- Amwan, P.S.-Both Gaya, district-Gayaji. 4. The contention is that this petitioner fought battle with Trustee Shivalaya Newtapur Sewait Ramesh Giri and others in Title Suit No. 49 of 2021. Later, they entered into a compromise which followed the stamped by the learned Sub- Judge-III, Gaya on 18.02.202. Submission is that thereafter, armed with the said order, the petitioner moved before the Circle Officer, Both Gaya but no final order has been passed. 5. Learned State counsel submits that proper petition probably has not been filed and only a representation is there. 6. Learned counsel for the petitioner undertakes to approach the concerned official in next four weeks alongwith a proper document/fees. 7. If such petition is preferred within four weeks, the Circle Officer, Both Gaya (respondent no.08) shall be putting all the stake holders on notice and afterafter shall pass an Patna High Court CWJC No.11850 of 2026(2) dt.07-08-2026 4/4 appropriate order at an earliest. 8.
