ORDER: This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
“… to issue a Writ, Order or direction, more particularly one in the nature of Writ of Mandamus declaring the action of respondent No.3 in passing order vide Rc.No.J1/8/2026, dated 30.04.2026 under Section 83(2) of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987 treating the petitioner as an encroacher and directing eviction from the residential house bearing H.No.5-5 situated at Varalakshmi Nagar, Vepagunta village, Pendurthi Mandal, Visakhapatnam District as illegal and arbitrary and consequently set aside the same and pass such other order or orders..…”
2. Heard Sri D.V.Sasidhar, learned counsel, representing the
learned counsel for the petitioner, Smt K.Ujwala Devi, learned counsel for respondent No.2 and Sri Deva Deepak, learned counsel for respondent No.3.

The learned counsel for the petitioner would submit that the petitioner is having other alternative remedy under Section 83(6) of Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987 and he would request this Court to permit the writ petitioner to file an appeal before the concerned authority assailing the order in Rc.No.J1/8/2026, dated 30.04.2026.

4. Permission is accorded to file an appeal before the Endowments Tribunal within a period of two weeks from the date of receipt of a copy of this order. On filing of such appeal, the appellate authority is
directed to dispose of the same in accordance with law. The respondents are directed to maintain status quo as on today for a period of four (4) weeks from today i.e., 15.06.2026.
5. With the above said direction, the Writ Petition is disposed of. There shall be no order as to costs.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
