Learned counsel for the applicant would submit that, WP No. 102/2006 was listed for hearing on 10-1-2023 but counsel for applicant could not reach the Court as he could not see the listing of the case in the daily cause list. Non-appearance of the counsel was bonafide, hence he prays that, instant MCC may be allowed and the WP No. 102/2023 may be restored to its original number. 3. On due consideration and for the reasons mentioned in the MCC, instant MCC is allowed. The impugned order dated 10-1- 2023 passed in WP No. 102/2006 is set aside. Registry is directed to restore WP No. 102/2006 (Shri H.C. Saxena Vs. The State of Chhattisgarh and ors.) to its original number. 4. Pending interlocutory application(s), if any, stands disposed of.
