1. By the present writ petition, the petitioner seeks a direction to the respondent authorities to consider and decide the pending departmental appeal dated 05.12.2025 (Annexure P-6) preferred by the petitioner before the respondent No.2.

Learned counsel for the petitioner submits that the petitioner was placed under suspension vide order dated 10.06.2024 issued by respondent No.4 in exercise of powers under Rule 12 of the Home Guards Act. He submits that the said order of suspension was passed without following the due process of law and in violation of the provisions of the Home Guards Act. Aggrieved thereby, the petitioner preferred a departmental appeal on 05.12.2025 before respondent No.2. He further submits that despite lapse of considerable time, the said appeal is still pending consideration and has not been decided till date. Learned counsel would also contend that the inaction on the part of respondent No.2 is arbitrary and unjustified, and a direction be issued to respondent No.2 to consider and decide the petitioner's pending departmental appeal within a stipulated period, in accordance with law.
3. Learned State counsel submits that if the departmental appeal (Annexure P-6) is still pending consideration, the same shall be considered and decided, in accordance with law, within the stipulated period.

4. I have heard learned counsel for the parties and perused the material available on record.

Considering the limited prayer made by learned counsel for the petitioner and taking into account the submission made by learned State counsel, this writ petition is disposed of with a direction to the respondent No.2 to consider and decide the departmental appeal (Annexure P-6) filed by the petitioner, strictly in accordance with law, preferably within a period of 25 days from the date of receipt of a copy of this order.
6. With the aforesaid direction, the writ petition stands disposed of. Sd/-
