ORAL ORDER
1. The petitioners are before this Court seeking for the following reliefs: (a) To issue writ of Certiorari or any other appropriate Writ or Order dated 10.03.2024, passed by Senior Civil Judge and Addl. MACT at Kundapura in MVC.No.1179/2019 on I.A.No.8 and 9 which is produced at Annexure-A.
(b) And also pass such other and further relief as this Hon'ble Court deems fit considering the
facts and circumstances of the case, to meet the ends of justice and equity.

Learned counsel for the petitioner submits that the above petition has been rendered infructuous and a memo has been filed to that effect, which reads as under:
"The above writ petition is filed challenging the order dated 10.03.2024 passed by the trial court in MVC No.1179/2019, wherein the

application for amendment filed under Order VI Rule 17 has been rejected on the ground that the application is supported by memorandum of facts instead of filing the affidavit. However, during the pendency of the above writ petition the petitioner has filed the fresh application along with an affidavit under Order VI Rule 17 and the said application is came to be allowed by the claims tribunal. Therefore, the above writ petition does not survive for any further consideration.
WHEREFORE, the undersigned counsel prays that this Hon'ble Court be pleased to dispose of the above writ petition having rendered infractuous and does not survive for consideration, to meet the ends of justice and equity."
3. Accepting the said memo and submission of the counsel for the petitioner, the petition is dismissed as having become infructuous.
