20.07.2026 Serial no. 1041 [G.S.D] CRM (NDPS) 908 of 2026 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Raiganj PS Case No. 1494 of 2025 dated 17.12.2025 u/s 21(c)/29 of the NDPS Act, corresponding to NDPS Case No. 82 of 2025. -And- In the matter of : Iliyus Ali @ Iliyas … … Petitioner(s) Mr. Jisan Iqubal Hossain … for the Petitioner(s) Mr. Gouranga Kumar Das, ld. APP Mr. Bikash Kr. Singh … for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is similarly situated as the other accused persons who have been granted bail in CRM (NDPS) 547 of 2026. Mr. Gouranga Kumar Das, learned APP, appears for the State along with a junior of his choice as per the direction of this court. The appointment of both Mr. Das and the junior of his choice, if any, be regularized by the concerned authority. Learned advocate for the State opposes the prayer for bail but is unable to refute the locus standi of the present petitioner with that of the accused persons who have been granted bail. Having considered the aforesaid, I am inclined to enlarge the petitioner on bail on the same terms and conditions as was imposed to the other accused [Ayub 2 Ali,Sabir Ali and Dilip Mahato] in CRM (NDPS) 547 of 2026. Hence, the prayer for bail of the petitioner [Iliyus Ali @ Iliyas] is Allowed. Accordingly, CRM (NDPS) 908 of 2026 is allowed. Memo of Evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Tirthankar Ghosh, J.)
