Rakib (Allowed) CRM (M) 1177 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Tehatta Police Station case no. 307 of 2015 dated 17.07.2015 under Sections 302/34 of the Indian Penal Code, 1860. And In the matter of : Uttam Mondal ……Petitioner. Ms. Rajashree Venket Kundalia .....for the Petitioner. Mr. Rajendra Banerjee, Ld. APP Mr. Sunil Gupta ……for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 11 years and only some witnesses have been examined. As such, petitioner may be released on bail. Mr. Rajendra Banerjee, learned Additional Public Prosecutor along with Mr. Sunil Gupta are appearing for the State. Their appointments may be regularized by the concerned authorities. Learned Additional Public Prosecutor appearing for the State submits that all the prosecution witnesses have been examined and date has been fixed for arguments. Having considered the period of detention of the present petitioner and the report submitted reflects that next date is fixed on 04.08.2026 for FSL report, I am of the opinion that some more 2 time will be required to take the proceedings to its logical conclusion. As such, I am inclined to release the petitioner on bail. Accordingly, the petitioner, namely, Uttam Mondal shall be released on bail subject to the satisfaction of the learned Additional District and Sessions Judge, Tehatta, Nadia. If on bail, the petitioner shall ensure he is present physically on each and every date before the learned trial Court. Thus, CRM (M) No. 1177 of 2026 is allowed. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
